Default Lease Contract

A colleague of mine who is also trying to move to PA just got screwed over big time - I heard his story and figured there might be a way out.

Here is the down low:

This guy saw a house he wanted to rent and being that he liked what he saw he filled out forms for a credit check, consumer notice and a rental application with Rundle Real Estate where the listing agent works. The listing agent told him he could not find the lease forms and will overnight or fax it over the next day. He passed the credit check and was verbally offered the rental. He requested the lease forms again and it took eight days for this listing agent to fax it over. He signed it and faxed it back but never heard anything so he called and left several messages for the listing agent who never cared to call him back. He called the listing agent today only to be told the place had been rented out yesterday because they never heard back from him....now the good part is he left a security deposit and the first months rent check. He has already given his current landlord a notice stating he is moving out by June 30th.


Now my question is does this listing agent have the right to not notify this guy that he put the place back on the market or they were no longer interested in renting to him. Also the funny part is he faxed some other documents along with the lease form and the listing agent made a reference about one of those documents but states he never received the lease forms which sounds shady.

What can this stranded guy do about this, what are his options, what exactly can he do and not do?

The law clearly states "there is no contract" if there are no signatures, therefore, you have no legal recourse but to make sure to get the word out about the agent so others will stay away. Bad news always travels faster than good news and in this case, that is a good thing.
