Ok. This is from one of the most highly respected and experienced commonwealth attorney in Va. This man knows Va law better than anyone I've ever known. At least criminal and traffic. I explained the constant doubt on here. Here is his response.

I’ll type slower this time so hopefully it will be easier to understand. If charged and convicted of reckless driving on a summons, the clerk’s office only reports the conviction to DMV. If charged on a warrant and processed, i.e. fingerprinted & photographed, the conviction is also reported to VCIN. I guess if the magistrate issues a warrant but checks off that it can be executed as a summons and the person is released by the officer on his signature, then the conviction would also only be reported to DMV since the person was not taken into custody and processed. Bottom line: Summons = DMV record. Arrest on Warrant = VCIN record.

Heck yeah hire a lawyer, that's messed up. I hate law enforcements who abuses their power to get away with it.

Um, the horse may be out of the barn. Doubters of any serious interest are likely to have already visited independent sites such as wikipedia where they will have read things such as the following...

All drivers convicted of reckless driving in Virginia, including out-of-state and foreign (e.g. Canadian) drivers, will have a permanent criminal record that will be indexed in the NCIC criminal database.

You are really something else. And if Wikipedia is your source then you need help on the web my friend.

I was in Navy, and I got a ticket, in Virginia, driving Texas to my VA Naval base, this July, and the code is C.46.2-862. I filled out the trial by absence and mail back to court, and now I realized the penalty is so serious, will help to hire a lawyer? As, being in navy now, what can I do, shall i report to my office? Plus the court is 5 hours drive.
