Yeah it can happen. It happened to me once when I was younger. Not necessarily because of the signage, I just don't think I was paying close enough attention. I was on the toll road very early in the morning heading east(a route I didn't normally take) and didn't realize where it dumped me onto 66 was only HOV until it was too late. It was my one and only HOV ticket though.

Is there anywhere else in the country where the ENTIRE highway turns HOV? I'm sure this mistake is made frequently by out-of-towners or people who just moved here.

Many people who come visit NOVA can't believe all lanes turn HOV during certain times.

This can only work if the officer cited you within the HOV time period and you clearly was not in. If not, the Starbucks recipient works against your favor. You basically telling the judge that you are guilty.

I didn't set-out to be a HOV Violator. It was a mistake because they made all of the lanes HOV and I wasn't aware of it.
I can be when dealing with people who, by your own admission wern't paying attention.

I, too, think the judge is not going to be sympathetic with a 2nd violation. One would think after the first ticket, a violator would become familiar with the laws to avoid a second offense. The technicality doesn't prove the OP was innocent. And, how many people do you think go into a Starbucks in a single day? Is it reasonable for an employee to be able to validate 4000 customers ago that a certain one was there? Or that a particular customer signed their slip? Seriously, I think the attorney is seeing $$$. I think the OP has a better shot that the cop won't make it to court.

Not trying to be brutal, just calling it the way I see it......which is, if found guilty for the 2nd time, get that checkbook out. Ouch!

Yup, that's why I asked earlier if the attorney was billing by the hour, because I think this whole "find the Starbucks employee" is a huge waste of time and only serves to line the lawyer's pockets.

What is the time listed on your ticket? The time in the morning where 66 inside the beltway is HOV only is between 6:30 a.m. to 9:00 a.m.
