Hello All,

I wanted to follow-up regarding a previous post, whereby someone was trying to find out information about the HOV Violation Rules.

I also received a Citation for an HOV Violation, and this would be my 2nd Offense.

My question has to do with the fact that the Officer made a mistake on the Citation.
He basically put the wrong time, being 1 hour later.

I wanted to know if anyone has tried or successfully contested their Citation based upon this type of error?

I also have a Starbucks Receipt which indicates the time just minutes after the time on the Citation.
This Starbucks is 5 miles away, and there would be obviously no way that I could have been receiving a citation and getting Starbucks at virtually the same time.

I would like to see the look on the judge's face if you try to contest the citation based on the wrong time. Don't mean to be flippant, but I think that's pretty ridiculous and only further evidence that you haven't really learned your lesson.

But you knowingly were in an HOV w/o the required people and knew it? No idea if the time thing will help or not.

The Starbucks receipt proves nothing. What if Starbucks had the wrong time? What if someone else was using your card?

The only way the time mistake could get you out of this is if the time written on the ticket is a non-HOV time.

I actually just spoke with an Attorney, who told me that the Infraction Time has everything to do with the validity of an HOV Violation. And btw I did learn my lesson. I was completely unaware that All Lanes within the Beltway on 66 are HOV Only for certain times of the day

Correct. This Attorney wants to take this on for the fun-of-it. In fact, he wants to Supeana the Starbucks Employee to support the validity of my Credit Card Receipt.

What are you some kind of prick?
I didn't set-out to be a HOV Violator. It was a mistake because they made all of the lanes HOV and I wasn't aware of it.
