I'm totally with you on this. I have a problem with possibly having a criminal record just because I drop 1 f-bomb or flip the bird to someone who deserved it.

The police likely swore out a warrant based on the info given by the victim. Or the victim herself could have sworn out the warrant which the PD served.

But how do they prove the content of the conversation? If we chatted about the weather for 10 mins and hung up, can I just call the police and complain that you had spent 10 mins abusing and threatening me? Do they ask for phone records from the carrier? Wouldn't the financial costs of going through this ordeal be enormous?

It sounds to me like one of those "if all else fails" statutes where if they really need to take you in for something, they always have something in their back pocket. There are so many laws, you are almost certainly breaking one at some point in a given day.

The police don't have to prove anything. That's up to the prosecutor. The testimony of the victim will make or break the case. It's also possible she rcorded the conversation after many similar calls. Who knows. There may have been a pattern and she finally got the police involved. The police may have obtained the warrant based on the victims report or maybe she got the warrant herself and the police did nothing but serve it.
