I'm confused by this question. If you defaulted on the contract, you owe them money.

What does your lawyer think? Good heavens you did have a lawyer read the contract before you signed it right? You'd better believe that I would never sign anything without a trustworthy lawyer's insight when half a million bucks (or more) is on the line.

Good advice, but after the fact so what's done is done... the more important question is, you DO have an attorney representing you NOW, yes?

Patti47.. what is the reason you used to backout of the contract? What is the status of your house? if you still owe $50K, then it must be in the initial stages.. when did you inform them about the backout.

Folks, toll brothers gives HOA docs at the time people sign contracts and their HOA docs will never gets updated although they have new schools, streets or anything because when there is an updates to HOA docs people have right to use that to backout of the contract.

Our current house is not sold.
We are already in default with Toll contract.Now they have retained our deposit(50k)and has referred our case to collection for the remaining 50k of the promisory note.The collection agency is calling us on and off for the money.i

Why oh why did you go under contract and give them $50,000 without selling your house first? You really need to get a lawyer. Unless there is something in your contract that releases you from your commitiment, maybe you can work out a payment schedule that you can afford. If you agreed to their terms, you owe them the money.
