We have an issue with the shopping center near our home and their trash. It completely clogs the county drain pipe and grate therefore washing trash into our yard and causing the drainage to come through our side yard like a river instead of the drain creek it is meant to go in outside our property line. It has caused EXTENSIVE damage to our property, made our back yard a flood zone and therefore we can not even use half of our lot!!!! It has eroded the foundation to our building in the back of our yard, as well as the back wall of the building and our chain link fencing. It is ridiculous. We have asked the shopping center to clean up their trash so many times I can not count and we DAILY have to pick up trash in our yard. It is disgusting. We are ready to get a lawyer. This issue is not only infuriating, it is embarrassing and we now have to smell that awful sulfur smell that comes from the clogged drain pipes. Our water now stinks and we are just DONE. Please advise.
As a side note, we have pleaded with the managaement of Shoppes at Cedar Lakes (Rite Aid, IHOP, etc) and the Chevrolet Dealer as well to take care of their trash issues for the past 3 years. It is THEIR trash causing all of the issues. I have pictures to support our issues.

Before getting lawyer, I would try talking to your County's Zoning office or Code Enforcement office (usually within the Zoning Office) and see if they can resolve the issue. The shopping center is likely in violation of their site plan conditions if their trash is washing away into surrounding properties.

1) why has it taken you three years to take action?

2) do you ask them in writing to remove the trash and what is their response?

3) Get an attorney!! Random internet advice will not help you more than a knowledgeable attorney.
