I recieved a reckless driving ticket in Fairfax 87/25. I was on the toll road and pulled over just in the contruction area as the speed had dropped. Either way you cut it I was speeding and shouldnt have been. I have a clean record, both driving and criminal. I have a court date set for Oct 2nd. I know the "worst case scenerio" but does anyone know what type of penalty I am actually looking at? I have started to call a few lawyers and am not sure if they are putting a scare tactic to try and get my service? I plan on hiring a lawyer, I just want a lawyer that will be competent and reassuring. I also think it is a little strange that some of these guys answer their own phones, and answer them on holidays and weekends.
Please let me know if anyone has a "clue" as to what type of penalty I am looking at and any suggestions. I am not sure if it matters, but I am a resident of NJ..

It all depends on what your lawyer can work out. He or she will play up your positive record heretofore, but 87/25 in a construction zone is not going to earn a lot of sympathy. Additionally, the Toll Road is notorious for speed voliations, so you may initially be labeled as one of them. Reckless attorneys in the area do not need to drum up business. They have plenty enough work to keep them occupied. This is a serious charge (particularly if 'Criminal Court' is checked on your citation, rather than 'Traffic Court'), and you should take it as such. Retain an attorney you feel comfortable talking with, tell him or her the truth, then faithfully do what you are told to do. You might want to start practicing being contrite, and apologizing for having let your poor judgement put the people (and construction workers) of Virginia at such risk. There are no excuses, so don't try to profer any. Best case scenario is that you will be out of pocket a couple of thousand dollars and will have some nice new points on your record that will drive your insurance rates up. That's the upside. Things can get much worse from there. Your goal is to walk away with no more damage than that. Most people do manage it. Being from NJ will, if anything, be a negative, in that it puts you closer to the stereotype of selfish New Yorkers speeding their way down to Florida and killing off law-abiding Virginians as they go. Part of your lawyer's job will be to talk that bit out of existence...

You probably won't get off free and clear under your circumstance...but definately get a lawyer, and see if she/he can get the judge to reduce your charges based on your driving record (assuming it's stellar); pay the fines, and move on with your life. A reckless charge definately, sucks, but again it isn't the end of the world. But hopefully you can get the charges reduces, so you take a lesser hit on your points, and insurance premiums.

I am mainly worried about the possiblity of going to jail at this point. I have no problem paying out of the butt to even avoid any record. Anyone I tell in NJ pretty much laughs it off and says "ITS A SPEEDING TICKET!!".. Any advice to avoid Jail is greatly appreciated.

Well, it's only up to a year in jail. Not like a life sentence or anything. In NJ, it would be just a speeding ticket, but Virginia is very different. The state legislature has gotten sick and tired of people paying no attention to traffic laws and other people dying as the result of it. They mean to get your attention -- and everybody else's while they're at it. Slow down, or we'll hammer you, is what they are saying. That said, it is usually only idiots or repeat offenders who draw jail time. Get an experienced lawyer you're comfortable with, do as you're told, be humble, contrite, and repentant, and all you'll lose is some time and money. Remember that only an attorney can negotiate your case with either the prosecutor or the judge. You can't. So make sure you are completely truthful with your lawyer, then let him or her do the job. You'll walk away being glad that you did...

Default Reckless Driving in Fairfax

hi,
Toady I have got ticket for reckless driving 46.2.862 on 4110 on chain bridge road. This is my first ticket since I having drivers license . I am just exremely worrried that what will be out come of this. I never speed I am not sure how my speed limit went up. I had been asked to apper in genral district court triffic. What will be the maximum citation can be given to me. Please help.

wait, you were doing 87 on a 25mph zone? Holy crap. How is that possible? lol, I would think if it drops down to 25, there's a reason why it would be so slow o nthe toll road.

I know it is confusing, but if you take a look at the dates an names on veach post you will see that the most recent poster is not the same person who did 87 in a 25 zone.
