Burgers+Beer is on a distinguished road
Default Legal question about a release of Liability

My wife recently slipped on a wet floor in a grocery store. The grocery store had just finished mopping the floor but had neglected to put one of those yellow wet floor signs. She hit her knee pretty hard. We went to the doctor and she did have some swelling and brusing but no ligament damge and nothing was broken. The grocery store paid for our doctors visit and asked had us sign a Release of Liability.
Now a few days later my wife's knee has started to hurt again. I was wondering if the release of liability has prohibited us from trying to get additional reimbursement of any doctors visits. Since we do not have health insurance this could get expensive. An additional note of information, my wife was hurt but i was the one who signed the Release of Liability, she did not sign it but was standing beside me. Any help would be appreciated.

First, I'm sorry to hear your wife was hurt. In reading your post, I'm most concerned that you do not have health insurance. I say that not in a mean way, but I'm just concerned for you. Once it has been established that your wife is OK medically speaking, I would work (and you may be doing this right now) to ensure that you are finding a way to become insured.

That being said, I think you could seek the advice of an attorney, but I would talk to maybe a local legal society or something. The last thing you need to do is spend hundreds of dollars in attorney fees for nothing. A good attorney should give you 30-45 minutes to see if you even have a case.

Last but not least, is it really worth it to go to court and fight this if indeed your wife has no long term health effects? I might consider having a conversation with the store manager, district manager, etc. Just keep calm, keep everything documented and don't be afraid to seek help from your pastor, friends, etc., if you need some emotional support.

Best of luck to you!
