I'm pretty sure they're legal, depending on your county/city codes. But I don't know where you'd buy them this time of year locally. Usually you can get them from any fireworks stand in June/July, but all of those turn into Pumpkin stands this time of year.

You don't say where in NoVa. Sparklers are illegal in the city of Alexandria, as are all other types of personal fireworks. That doesn't seem to stop people from using them, though.
The Alexandria Fire Department reminds those who visit, live and work in the City of Alexandria that it is unlawful for any person to store, offer for sale, expose for sale, sell at retail, use or explode any fireworks (including sparklers) within the city limits.
The Fire Marshal will, at the owner’s expense, seize and take all fireworks found in the city. The above offenses are class one misdemeanors in the city and are punishable by a $2,500 fine and/or up to 12 months in prison.
Fireworks violations may be reported to the Alexandria Fire Department at 703-838-4360 or the Alexandria Police Department at 703-838-4444.
Fairfax Co is more lenient, see News Release - Fire & Rescue - Fairfax County, Virginia

In Virginia, all fireworks are illegal unless approved by the city or county. You'll need to check with your particular jurisdiction.

They are legal in Loudoun and much (but not all) of Fairfax county. That said, I tried to find them in VA a number of years ago (outside of July 4th timeframe) and couldn't find them. I think the fire marshall has to approve places to sell them, and many places don't bother with the permits.

There is some place in Pennsylvania, near the MD line, that sell and mails a bunch of stuff. If you cna't find it with Google, I can check with my friend. They make a run every year, and he's shown me the catalog. There is a touch of pyromania in us all--it's natural.
