Verizon installed FIOS and ruined by driveway. It was not evident until a few months later (after a freeze). A whole section of the driveway "heaved" upwards. I had a devil of a time getting it paid for. I worked through Verizon and they worked through to their subcontractor. They came out, dug up the entire strip of damaged driveway, and laid new asphalt. Quite honestly, I wanted the driveway replaced because it's just not right anymore. But I would have had to lawyer up for that.

In this case, damage stems from potential negligence by a 3rd party, which caused an exterior feature to damage the unit's interior. An installer breaking a pipe is a different situation from a pipe leaking due to old age. There is culpability.

I owned and lived in a condo when a room flooded during a heavy rainfall, due to a defect with the building's exterior. Water was streaming down inside the walls and then into my unit. The management company fixed the exterior defect, as well as cleaned and fixed damage on the inside of my unit. I did not have to file an insurance claim, even though I carried homeowner's insurance.

Without having an insurance policy presents a problem, because instead of having them do the work of pursuing a claim, it appears the owner will have to get a lawyer to file a lawsuit.
