I'd wait until Monday to talk to her. It is a holiday weekend and she might be out of town without internet access, yadda, yadda, yadda. Have you checked with the sheriff's office about the timeframe regarding giving notice to a renter? They might have some kind of requirement.

She probably got laid off or got fired. Either way, you want her out before she drops another line on you about not having anywhere else to go because she has no income.

I think the timeframe as I understand it is 30 day notice in this state as I am a occupied landlord. The lease agreement states 6 months occupancy, but since I live here, I think I can get away with kicking her out with 30 days. Her rent is coming up on Dec 1st and if she tries to argue not to pay for some reason, better for me because then I can declare rent not paid and kick her out with 5 day notice and get it through the sheriff dept.

She's leaving no later than the month of Dec. I've made up my mind and its not going to change. I've gone through several security measures at my place to ensure she won't try any funny business.

Just a follow up question I'm planning on filing a civil lawsuit against her for the whole price of the couch. Any opinions?

I'd say call it a lesson learned for having a roommate with no security deposit. Just be thankful you have her out of your house when it happens.

I'm seriously glad I have never lived or worked with someone like you.

I mean seriously, this person is paying/helping to pay for the stain removal. You're kicking her out before her lease is up, threatening to involve the sheriff's office (who by the way, may not give a darn about any timetable of yours). You air all of her dirty laundry on an internet forum, as if you haven't made any mistakes such as, let's see, not even trying to come to an understanding with her as to what's allowable or not, not taking in a security deposit, waiting until it's a "BIG DEAL" and not trying to work things out sooner, etc.

As far as the couch, take a huge chill pill. Suck it up. It's a freakin' stain on a couch. Whoop-de-freakin'-do.

There are things called life lessons that most of us benefit from experiencing and then learning from. Get a little humility, and keep that remnant stain prominently in your sight to remind you to stay humble. The poor girl is suffering enough, both from her own poor cleanliness and from living with you. Suing her is rubbing salt in her wounds, and won't give you the satisfaction you're looking for. If anything, it will just make you both bitter.

You don't think you're becoming a trifle obsessive about this whole thing? I suppose you can try if you want, but this thing seems to have become all consuming, and with the amount of time such a procedure is likely to take, you're going to be thinking about this episode and dealing with the ramifications for ages.

Further back on this thread I suggested that if you wanted to get a roommate again you make sure you have a trial period. I would now say you are temperamentally unsuited to sharing your living space with anyone.

Why bother? It isn't worth it. She already paid for the repairs (right?). This is just more headache for you and the time, energy, and costs involved wouldn't be worth it. Just be glad that she's gone and, as others have said, chalk this one up as a lesson learned.

i would rather live in a mouse hole than have roommates. when you live alone, guaranteed-- never more than 1 crazy person in the house.

I think everyone has already stated the things that popped into my head while reading this. I understand your frustration, having lived with messier-than-me roommates in the past, but I think you're over-reacting with the whole sheriff eviction and lawsuit over the couch process. Part of having a roommate is that you must be flexible and a little forgiving in your lifestyle.

That being said though, I'd be pissed about my new couch being messed up too. I would've confronted her and worked out a verbal and written agreement with her prior to going to these extremes. Since you've already given her 30 days notice, make sure you document all of your property. Take pictures and document everything in common areas to make sure that she doesn't start to destroy other stuff in the next 30 days over frustration. Also, I'd recommend a plastic slip cover for your white couch in the meantime to keep it clean.

In the future - know your roommate and their bad habits before living with them. I'm renting a room in my house to a good friend of ours that's a messy person. We made it extremely clear with the lease before she moved in what our expectations were for cleanliness in common areas and her room. Even with friends, you have to be very specific on what you need, I can't imagine renting my own place to a complete stranger though.

Eh, I don't blame him. The couch wouldn't bother me as much as the fact that she continues to lie about something that can only be her fault (assuming the OP is telling the truth). Can't trust someone who would blatantly lie...who knows what else they'd try to pull one over on you for.
