I'm hoping someone on these forums knows the answer to this. I have searched and searched to discover if a personal--not a charitable organization--raffle is legal in the state of Virginia.
In other words, we want to have an ART FUNDRAISING raffle featuring a huge canvas and the VA codes are cryptic for lay people to understand.
If anyone knows or has had raffles with no problems or simply knows the ACTUAL law (not just the definitions or what the code unclearly says) please let me know.

Again, I have looked up and read the gobs of info on VA code but none are lucid and I am terrified to enter into a raffle not knowing if it's truly legal.

The question I asked was the following:


I want to do a raffle, but I am 22 years old and am not trying to get a law suit over it. What do I need to know? The woman on the line asked if I was a business, corporation, or a charitable organization. I answered that I am just a 22 year old guy trying to throw a personal raffle for my buddies to buy in and have a chance at winning something. Her response was that if it is a personal raffle the state does not have any say in the matter & assured me they do not interfere.


I hope this helps someone. I'm sure a lot of people have googled this and ended up in this thread with no luck.

I'm surprised that they wouldn't want to tax the proceeds of the raffle...

They do. If you as an individual receive money from a personal raffle, you are required to report it as income. When you file your federal tax any additional individual income not derived from salary, interest, dividends, business, etc. (i.e your personal raffle income) is required to be reported on IRS Form 1040 under line 21 Other Income. Virginia requires the individual to report federal adjusted gross income from your federal tax form 1040 on Virginia Tax Form 760 line 1.
