The city of Broadview Heights is being sued by 2 gas companies. BVH residents had voted to ban any more fracking sites. But now~

"Any effort by Broadview Heights to prohibit or regulate the location, drilling or operation of oil and gas wells is thus preempted by state law and of no force or effect," the companies said in the lawsuit, filed June 10 in Cuyahoga County Common Pleas Court.

...Madion said there is "considerable doubt" that the city will vigorously defend the lawsuit. "Both the mayor of Broadview Heights, Samuel Alai, and its law director, Vincenzo Ruffa, have made public statements expressing doubt as to the enforceability of the (drilling ban)," MADION said in its motion.


...Madion says the state of Ohio has failed to protect the people's rights, so residents of Broadview Heights have the right to protect themselves.

We are supposed to live in a democracy, but it feels as if the Oil & Gas industry is hijacking that.



Columbus is trying to enact our own bill of rights to stop more radioactive waste dumps being approved, and to get oversight for the ones that are here. The state isn't doing it. But what's the point if its not enforceable?

Corporations are people, so I think the companies will win their lawsuit. The USSC has made it clear with its rulings over the past few years the general public has little say in the government process these days.
