Well I say that prostitution should be legal. What two consenting adults do is no one's business. So while I don't support having people arrested for sex, I'd have to agree that's the only way to get someone doing illegal activity out of your neighborhood. So be a neighborhood watcher and report suspicious activity.

Unlike some of the false purported rights you'll see people claim on this board (right to peace and quiet), the 4th amendment of the US Bill of Rights does protect our privacy in our own home. So I dare you - watch inside your neighbors windows and catch them in the act of sex. But when they see what you're doing, you better run. Don't expect the police to have your back.

Hear! Hear! Also if you just catch someone having sex all that's not a crime there has to be proof that money was exchanged. The financial transaction has to be caught not the sex act.

The 4th Amendment protects you from illegal search and seizure by THE GOVERNMENT. It doesn't protect you from nosey neighbors.

Originally, yes. But our Surpreme Courts have interpreted this right more broadly to mean that a non-public individual has the right to privacy from-
1. government
2. neighbors
3. private affairs
4. private information
5. publicity which puts you in a false light to the public
6. appreciation of your name for personal or commercial advantage

It isn't the 4A itself that gives invididuals that right to privacy, that comes from subsequent case laws and legislative laws.

If you were to try to sue an individual for violating your 4A rights, it would get tossed out of court in a heartbeat. It is valid for tort claims against the Federal government (and state and local government thanks to 14A), but not for claims against individuals.

In spirit, you are correct, individuals have a right to privacy, but the Fourth Amendment itself actually only applies to those situations involving having that right violated by the government.

Now that we're done arguing the finer points of constitutional law, what was this thread about again?

Dude doesn't even know what is and isn't a crime, so I would NOT waste my time trying to explain constitutional law to him. You might as well try teaching chaos theory to a dog.

Something I cannot understand is why it is Legal (in most states) for paid Porn actors to perform sexual acts in front of a camera but when a Prostitute asks for money for sexual services it is illegal? Seems like a double standard to me.

It is, however in some jurisdictions it would still be illegal because of laws on the books. That's why most porn is shot in California and Florida.

Maybe just maybe my friend didn't want that type of business going on next door to her house, with her kids playing in the front or back yard? I've seen some of the men that showed up to that place, and I wouldn't want my kids anywhere near it or them.

I realise there's rights and you don't have to be nosey to notice certain things that's going on in your neighborhood. You don't have to sit and watch the house night and day to pick-up the fact illegal activity is happening.
