Just to add to this. Legally what is in that dumpster is still the property of the store. And remains so till it is picked up by the collector, which at that time it becomes the property of the collector. Who is under contract with this store. So if you were charged with theft by an local authorities, the store itself would have to press the charges, ultimately being left in their hands as to proceed or not. Talking with a manager friend of mine who works for a larger chain store, he said more than likely the person would recieve a verbal waring from the store first, if they returned they would have the person charged. They would need to do this for safety reasons, not only on the store's behalf, but for safety of the public who may comsume outdated or contaminated food from a dumpster. Like he also mentioned you do not know if this food accidently had something spilled on it that would make it unsafe. Or possibly been in a the store where a refrigerent unit went out and the food became to warm allowing bacteria to grow. Many things could of happened he informs me, not just that it was tossed due to expiration dates on package.

LOL @ lawyering up over this because you don't want to lose the ability to save a few dollars on groceries by taking them out of the trash shortly before they expire.

I've never spent all that much on groceries, so I'm baffled at why people would spend time digging through dumpsters. Somebody like this was actually on the Daily Show or the Colbert Report last night (can't remember which). Funny stuff!

bighusker - How many kids do you have? My sister has two kids and shops as smart as you possibly can yet her monthly food bills is still $200 - $300 on a good month.

just a couple legal issues i know about :-)1. if there isnt any signs, there isnt any trespassing, this protects your right to walk up and knock on someones front door.2. if a cop tells you to do something and you do it, and get arrested, this is called entrapment. entrapment is very bad for the cops, cause now its their time to go to jail.3. as far as theft is concerned... in most states trash is considered abandoned goods, so no you arnt going to jail for theft. Tell the cops to kiss your ass ;-)
