Default dog attacks

Hi unfortunately my dog escaped from the side gate of our house and he problem is that my dog jumped onto my neighbor's back. Supposedly she thinks her back is broken and she did call animal control on us. This was a one time instance, would she be able to sue us? Please help he was a 9 month old golden retriever, he was actually getting trained right now, but I don't know if our family is going to put him to sleep. Does she have a case against us, the dog owners?

You need to ask an attorney, not the forum...

I would think she does have a potential case against you. It is your responsibility to make sure the gate to your home is not something the dog can escape by. If a gardener or construction work left it open, then they could probably partially be at fault, but ultimately it is your responsibility to restrain your dog. You would have to describe the entire situation in detail to an attorney though.

Put yourself in your neighbor's position.

Imagine if your dog attacked his kid and caused permanent scarring. I grew up with a kid like that.
