I just finnish pre hearing talk with my attorney. Not only does he thinks its age discrimination but also that I was injured on workers comp two months earlier discriminated for that too. Its going to come down to he said / she said and what the judge thinks. My problem is I,m headed for the mission if I lose. companies problem is if it was discrimination thier going to lie to cover thier butts. I never though going past age 60 was going to be such a drag. I talked to someone on my crew and asked if thet filled my position. He said no but they offered the job to almost everyone but they all turned it down for what they did to me. I was very good at my job and treated them with respect.

I just finnish conversation with friend who used to be a manager and worked on grievance committee for different company. After explaining my case with her she said dump the age discrimination case and pursue the workers comp case. after I was injured company was trying to get me to go on personal leave and use up my sick time. she says by law they have to start a 801 report within 72 hours of accident and it wasn't untill 2 or 3 weeks later that I filled that out. And to add insult to injury terminated 2 mos. after coming back to work. she also says my comp claim is open for 2 years after injury and I never signed off it. Interesting how this may be turning in my favor.

I've worked as a hearing officer for both unemployment and workers' compensation, albeit in a different state. There's nothing wrong with pursuing all three. I'm glad you have an attorney for the UI case, that will certainly help, as it would appear that you have a good case. File the age discrim complaint with the EEOC, let them investigate. As far as your comp claim is concerned, if it has not been closed, you may get some help there, too. Most workers' comp lawyers will do a free initial consultation -- check the yellow pages in your area. Take whatever paperwork you have on the comp claim, and go see one.

thanks for the info...I'm waiting for hearing results anytime now. What I was amazed about hearing was there was 3 company officials and even though we all were sworn in to tell the truth 2 of them told blatent lies and one was evasive. I figured a little bending of the truth a little on there side but not outright lies. I asked my lawyer after hearing that they perjured themselves and couldn/t they go to jail for that and he said the DA never prosiqute there cases. We were able to get in all good points for future case. I never changed my story from begining to end. My lawyer said that he has never seen such an effort by a company to prevent someone from recieving UI benifits and I said they know that if I win it will make follow up case that much better for me. I want this to go to jury trial but I see them settleling out of court.

I lost the hearing...but I did establish that I was on vacation so I didn't abanbom my job . The perjured statements by the three company officers were entered in as fact. I still have an appeal.The good part is there was a consperisy to commit perjury by 3 people to willfully denie public benifits. This is the first time in my life that I tried to collect unemployment benifits and I.m starting to get a little pissed. Does anyone know how to get them hooked up to a poly machine. I knew this would come down to he said/ she said but to allow perjury as fact in a case. As far as testifiying under oath maybe we should just skip that since there are no penalties if violated. Oh thats just for the employee to tell the truth. I don't want to give out name of company or personal names but I will give this
1.HR Director...willfully perjured herself. took 2 sentence I said and added a whole paragragh saying I quit resigned and refusesed to go back to my job...just her and me in the room. she never asked me to sign a resignation form....Hmmmm if I,m so bold we she is giving me my final chech why not ask me to sign something.
2.Manager of personal. after asking for transfer to another department and saying I would be patient....were did he get that I quit, resigned and wouldn,t go back to my job...perjury under oath. also one on one. no witnesses.
3. Plant Manager.. called him 10 min befor going into personal, curtesy call. Just letting him know I was going into personal to see what I could do about situation with my manager....He testified under oath and perjured Himself by saying that I called him and said I was cashing in my chips, cashing out my 401 and that I quit , resigning and not returning to work.....connect the dots here, 10 minites later I,m in personal requesting help in a transfer and that I will be patient and I,m just starting my vacation.....Hmmm
