Right to work state has nothing to do with at will employment. At will employment means either you or your employer can terminate your employment at any time and for any reason. The employees of Dixie Stampede were most likely employed at will. Right to work means you do not have to belong to a union to work certain jobs. In other words, closed union shops are illegal in right to work states.

I was under the impression that the 2 were intertwined. For example, recently a title company in the area layed off a number of staff with no notice. These are qualified professionals who have a contract, so no-one can claim its because they work in an industry like the entertainment industry, and it was stated that because Florida is a right to work state that they can do this. Perhaps im wrong but you have gotten me confused now....lol HELP...lol.

All i know is that im from the UK originally and under UK law a company can not lay you off without 2 week notice for part time and 1 months notice for full time and there are a list of benefits which accompany this. Whilst i understand the entertainment industry may not follow the norm, it does disgust me that these big businesses make alot of money out of their staff, but cannot extend the courtest of even just 2 weeks pay as a courtesy, particularly when in this situation, they didnt go banktrupt but merely sold the land to make a huge profit.

We have no such rule saying an employer has to give you a certain amount of notice. These people were also given a severance package. They could also be eligble to claim unemployment based on how long they have been with the company.

I know there is no such rule here in the US, i was saying that i think its disgusting that the onus isnt on the company to do that. So when you say depending on how long they have been with the company they can then claim unemployment. Do you mean unemployment as in welfare from the govt?

Default im just curious

I was just surprised and wanted clarification on what Lindsey meant when she said that they may be eligable for unemployment, whether that meant claiming welfare from the govt(in the form of unemployment benefit). It just seems to me that there are enough people on welfare without adding to it. Which is why i was comparing to the UK because at least with a package it gives people time to get a job without the necessity of going on welfare.

I dont know whether they have been given a package or anything but the reason i said that was it just sounded that way from the original post. But i wish them all the best.

Its just a shame because i heard such good things about it.

From what I recall a portion of the unemployment comes from the employer who laid them off or fired them but yes you can say its a form of welfare. It is however their right too collect in a situation like this since their employer gave them no notice of the fact their jobs would not continue.

Unemployment Insurance is insurance. It is in no way a form of welfare.

Unemployment compensation has nothing to do with how long you have been with a particular company. You could go from job to job & work for many companies & still collect as long as you have worked enough days within a certain period of time.

I wasn't aware of that so I geuss they have some complicated way of figuring out which employer pays what for your unemployment?

At any rate, I think when you have been laid off, you have every right to claim that unemployment, its there for a reason. It can lessen the strain on you until you can find employment. I know I did when I was laid off from my job.
