Default HOA pickup parking

I would like to know if anyone living in a homeowner association has ever been cited for being in violation of their communities bylaw regarding the parking of trucks? Specifically, if the truck was non-commercial passenger pickup truck. Before posting please read your bylaw. Does it state 'no trucks,commerical vehicles', or does it state 'no pickup trucks'.
Please post or send me private message. I am gathering information nation wide on this subject.

Mine says no commercial vehicles, you can park any kind of pickup as long as its not commercial.

Default Ocean Dunes - Pick-up Trucks

My HOA Rules and Regulations state "Boats, motor homes, trailiers, commercial vehicles, campers, trucks or any vehicle with any printing or advertising cannot be parked in Ocean Dunes."

We are being told by the property manager that includes pick-up trucks...even inside the garage.

I believe we are being given mis-information.

Can the HOA idscriminate against pick-up trucks, but allow equally large (or larger) truck vehicles such as a Chevy Suburban or Jeep Grand Cherokee?

Can the HOA regulate what type of vehicle is parked inside our garage?

Default Parking rules

Most HOA documents do have some reference or prevision to commercial vehicles being parked on the street or on a homeowner’s property. If you live in a gated community the documents may have given the board the authority to set parking rules since the streets in a gated community are generally private. If the streets are owned and maintained by the city or county then the city or county ordinances pertaining to parking on the street may prevail.
Your pickup truck being in violation could just be another case of inexperience board members trying to interpret the HOA documents and bylaws. It’s my practice to have an attorney familiar with HOA law and the states statutes pertaining to homeowners associations and condos interpret the documents and provide an opinion letter when a rule is not clear or the board is not sure how to apply it. It’s so easy to read in between the lines and misinterpret HOA rules. Sometimes the statutes will override the documents such as in displaying American flags and TV antennas. You can also go to litigation or arbitration and let the courts interpret the rule and how it applies.

Man I beg and plead that I don't get in trouble for posting this, but for the following things you guys are talking about, I have been trying to get people to participate in a local site. I am not going to list the link . Wouldn't you prefer to know about these things before you moved there?? Definetly find you an Attorney and protect yourself as much as possible. But I have yet found anyone that has been able to silence a bad HOA.

Moderator cut: forum I'm a community Association manager and will post on it from time to time. Keep in mind that all the homeowers in a community is the HOA and bad mouthing the board is not going to fix the problems. Homeowners have the power to vote in and vote out board members and make changes. Homeowners have to get involved and go to annual and board meetings and ask questions and have their board justify their actions. If we didn't have HOA's there would be a lot more run down neighborhoods and a lot of disputes between neighbors over fences, painting and landscaping. Good luck on your forum

I know you can park your own private use truck in the development. You can't park work vehicles with the exception of police cars, they don't say anything about that.

You also can't park RVs, campers, boats that kind of thing out where they can be seen.

There is a development up the road where no one can park in the street, this same one will not allow police to park their cruisers where they can be seen.

Then another one where you can't park with your tires on the grass.

I think the specifics can certainly change depending on the HOA.

I was glad to see mine allows police cruisers out inthe open, hopefully it will keep the little idiots who break into peoples cars around here on their toes.

Wow, a HOA who won't allow officers to park their cruisers in view? I hope they don't get many calls there because it might be a while before an officer is available to take the call.

Not to mention the board members better be going the speed limit when they are out driving.

I know, I thought it was stupid of them as well. I have a good friend whose husband is a cop and they rented a home in that development.

I am thrilled that we have three officers who live in our development and they leave their cruiser sitting out where it can be seen.

Must be a common thing now, my community does not allow the officers to park their cars on the side of the street! I would not mind by any means someone who's risking everything for me to park on the side of the street. It's the price we pay to maintain the values of the area but sometimes it requires a few residents to get together and make decisions when it comes down to electing the members I suppose.
