Hi,
I was wondering if anyone has any experience with Fl no-fault. My mom was recently in a car accident; the other driver ran the light in a company truck. Her car is totaled. She doesn’t have gap insurance and now the other insurance company is offering her about 3K less than she owes on the car, which will not only leave her with a bill but without transportation. Is there anything we can do about this? I’ve never been in this situation before but it seems to me like we’re getting shafted. No one was injured – which I know is the most important thing – but without a car, my mom has no way to get to and from work, as public transportation doesn’t go in the area where she works. My coworkers are telling me to seek legal advice, but the insurance company is telling me this is a pretty cut and dry case and a lawyer will just cost me money. I'm really not trying to get rich here; but I really am not seeing the fairness in this situation. Any advice? |

You should at least speak to an attorney, most consultations are free and most accident cases are no recovery no cost to the client. Of course the insurance is going to advise you not to seek advice, they're only looking out for themselves. They're the last person I would listen to, their interest and yours are completely opposing.

When a car is totaled they usually pay off at the blue book value. I usually purchase the gap insurance for this reason.
If a consultion with an attorney doesn't yield what you want, you also have the option of taking them to small claims court. Sadly that takes time. And that doesn't help you in the here and now. I'm sorry your mom is going thru this and am glad she's OK. |

Seek legal advice...
Do not deal with the insurance company. My parents just went through something similar...my parents are 75 & 69. It's trully incredible that you have to suffer even though you are not at any fault. |
