Default Help!

A tree fell on my car and crushed it. The tree fell from the neighbors property. Are they responsible to pay for the damage? I only have liability insurance and it's my only means of transportation?

Unless there was some negligence, such as the tree being rotted and they did nothing about it, then it is your problem. I had the reverse situation in 2004 after Charley. My tree fell onto my neighbors roof and he had to use his own insurance for repairs and removal.

Vehicles are excluded from homeowners insurance. Looks like I'm going to have to suck this one up!

What about your car insurance? I remember when we had a bad hail storm in the 80's. I had a brand new mini van at the time with dings all over it. State Farm paid for it to be repaired. Oops...sorry, I read your post again.

With only liability...I guess you're right about sucking it up. Looks like your neighbor would at least offer to contribute to the expense. Have you spoken to them?

My neighbor mentioned FEMA. I called them and they said they haven't approved any funding as of yet. I did ask them if they would help with assistance of that type and they said yes. There isn't that much damage in my county so I'm just keeping my fingers crossed. The land next door is vacant. I did get the owners info and I'm working on contacting them.

^ AONE is right FEMA is a joke! After Andrew I had a gaping hole in my condo ceiling which allowed rain & sunshine come in through naturally. The FEMA employee told me I wasn't eligible because I could still live on the property! Try it anyways and see what happens.
