Default Plz help with tax situation!!!!

My hubby has been a resident of FL, from PA, since July of 2005. Last year, somehow at tax season, we found out he had been listed as still a PA resident, and paid state tax (we don't have it in FL). He had filled out change of addy with his work, but perhaps someone screwed up??? Anyhow, he called IRS so that we could get that tax back, they sent some papers, and we filled them out and sent them back, months upon months ago. Then he spoke to head work people and made sure his addy was changed.

So now we get 2007 W2's. We received two of them- one for FL and one for PA!! It has him earning almost $40K in PA paying for state taxes, and then the rest of the year he got his FL return with about $25K on it. He lived in FL this WHOLE year!! He has not been in PA since July of 2005!!

We've been using turbo tax and loving it...but I don't know how to do the two taxes because when I'm answering questions, I am saying yes he's a resident in FL, no he hasn't received income from another state...but I have two returns and one is PA!!! Any help with that?

Does he contact his work about this obvious reporting mistake...or does he contact the IRS about it....?

I think that I would contact his place of employment and have them issue a corrected W-2. That's crummy that they continued to make the same mistake.

I'm not real sure how to go about it but I have moved several times and still recieved W2's from other states. Georgia is the worst! I use an accountant. It is WELL worth the money. You might contact H&R Block. I think they will answer these type of questions for free. Thats a sticky situation. I would ask a professional or three.

Well, I wish you good luck with this problem mrshvo. Sounds like something that can be straightened out, but you need to deal with the tax dept. in Pennsylvania. I don't think the IRS cares one way or the other about which state is claimed for residency.

Were his paycheck stubs throughout last year showing a deduction for PA taxes?

Sounds like some serious bookkeeping errors being made in PA. I’d notify the company about this discrepancy and ask for a corrected W2 or letter of the effect that this error was corrected. The owner or manager of the company might not like having bookkeeping records with the tax information being so wrong. I’d address “them” to correct the problem.

However your tax paper work becomes all messed up and more difficult to work with. You have to proceed with the idea that the income wasn’t earned and that the mistake will being corrected by those in PA. Keep a copy of your letters with the tax work indicating the errors.

Yes, for part of the year he still was having PA state taxes taken out. So I know we should get all of that back.

the company is the USPS!!!!!!!!!! Can you believe it?

Can we still just do turbo tax....I am so confused. He's talking to his work today about their mistakes. Will we get that tax back that we paid for and didn't live there?

USPS,,,,,,,,,,,,,, they shouldn’t have made this type of mistake with payroll. However it might be a good year to see a professional tax advisor who knows how to handle this type of situation best. Errors are always made from time to time, but you want to make sure that you’re covered and don’t have any problems.

Another thought ~ Have you talked with the IRS about what they think? Get names of who you speak with.

I agree and if this gets you nowhere I would visit your local IRS Office and get it straightened out face to face. You don't need The IRS on your back.

Showed this to my wife (IRS employee) and she says to talk to the PA State Tax dept. IRS has nothing to do with it from your explanation.
