Help me understand
Ok....
Back in February, my husband was hit but a red light running accident leaving waste of human flesh. (No bitterness here huh?)
The driver turned herself in a couple of day later and was charged with a 3rd Degree Felony. Posted bond, blah blah blah.
We've just been told TODAY (almost 5 months to the day) that the State's Attoney's office was going to have to drop the charges because the police report was never filed.
Here is my confusion...I have a copy of the 1st police report where no name is listed...I also have a copy of the 2nd police report with her information filled in. Insurance claims filed(an entirely different rant there) and some claims paid.
She was booked, fingerprinted, bail set, hired a lawyer and all of that...how in the world could have all of this happened if the powers that be didn't have a police report filed?? Everybody and their brother has a copy of said police report and now the State's Attoney's Office is stating they didn't get it?
Can someone help me understand how this could happen and what can I do?
I've already sent an e-mail to the trooper who handled the case. He works night otherwise I would have called him.

I would petition the State's Attoney's office to re examine the case, I would fax them copies of your reports, I would hire an attorney to investigate the lost report issue and yes I would talk to that officer and the head of his department, if it is true that the report was never filed which I doubt very much then you should sue every department responsable, I know thats not justice for the person who did this but it is for you because of their careless handling of this. My guess is that the attorney just didn't feel like pursueing this case, I've seen it before, raise a fuss and push it and they may prosocute this person. You should go to the media with your story.

Ok, somewhat of an update....I think I've started a war between the FHP and the States Attorney's Office....and no I'm not sorry.
I got a messege back from the trooper and HE IS MAD to say the least. I work for a local law enforcement agency..I'm not sworn but I've been around awhile so I started asking around as to how this can happen and I'm not too surprised that they (the sworn) are pretty much convinced the SA office lost the report. So I asked them what I asked here......what can I do now.....
Let me make some calls they said....30 minutes later husband gets a call from the SA office asking him to call off his wife. I found this quite amusing. It turns out our 2nd in command, calls THEIR 2nd in command and they hashed a couple things out.
In the mean time my poor trooper calls up and asks...just who do you know??? I just kinda shrugged.
Well the powers that be have decided that if the troooper "resubmits" the police report, they will reinstate the charges. We are to call back on Monday. Believe me we'll be calling 2x a week.
So those who don't have the people to call that I did...keep every single piece of paper from an accident. If I didn't have the troopers name and # or if we hadn't kept the original letter from the SA, this would have been swept under the rug and we wouldn't have know until it was too late. Let's hope this works and she doesn't get away with a felony.
