If she truly was not asked/talked to immediately/very soon before the procedure, then she has every right to be upset. A decision that you make before your baby is born is NOT the same as the decision you make after he's put in your arms.

We did not circumcise, and if someone had taken him under the guise of something else (like the PKU test) and cut off his foreskin, you bet I'd sue!

If she already said yes and changed her mind, though, then she should have made that very clear before they took the baby.... if she signed the papers and didn't say anything, then how could the hospital be at fault?

We can speculate endlessly, but the article said they had surgery because the parents weren't happy with the results. That tells me they consented after all, but that they had an issue with the results.
