Default I want full custody of my daughter

HI,

I was wondering if anybody knows how I can get full custody of my daughter? Her mother and I have been divorced 2 years now. We have joint custody but my daughter lives with me, Her mother doesn't support, call, or visit her.Do I have to go through court or can she sign her wrights away?

You have to go to court either way....just file a motion requesting full custody.

See if you can get mom to agree. That will make the whole thing less costly, time-consuming, and stressful.
Tell mom if she doesn't agree, you're going to sue her for child support, including back child support.
Chances are, she'll sign her rights over. This tactic works on deadbeat absentee dads all the time.

Chances are the courts are not going to let the mother sign her rights away. But the courts will most likely grant the OP full custody of the child as long as he can prove the mother has not been involved that much in the child's life.

I do agree that the OP should see if the mother/ex will agree to him having full custody outside of court. He will still need an attorney to draw up new papers and I think a judge has to sign off on the agreement, but niether party has to be present for that. If the OP can do this it will save a lot of stress, time and money having to go before a judge and bring up all of the reasons why he should have full custody.
