my father was in penn recently and a cop pulled him over saying he was going 85 in a 65. then the cop said he would do him a favor and charge him with "disobeying a traffic control device" which amounted to a $110 with no points. however, he wrote a comment in the "nature of offense" section where he said that the defendant was operating his vehicle at 85 mph in a 65 zone.

he is ok with paying the 110 fine with no points but is concerned that this note opens him up for a speeding charge with points.

it looks to me like he can just plead guilty and mail in the $110, but i want to be sure he wont be hit with worse.

any input? thanks!

I pleaded not guilty to a speeding ticket with the hope of having it changed to "disobeying a traffic control device." At the hearing the cop and magistrate agreed to change it. He was charged with one moving violation; how could pleading guilty open him up to a different violation? Plead guilty, pay the fine and forget about it.
