So far it looks like the cases are going up: Marijuana involved in 12 percent of Colorado State Patrol DUI cases - The Denver Post. But we do need better reporting on the information that is gained from the citations. It might just be too early to really say.

You are correct, because there aren't really any clinical FDA approved trials since possessing marijuana is illegal. By definition, there can be no clinical trials.

President Richard "Tricky Dick" Nixon was of the opinion that marijuana use by GIs in 'Nam was sabotaging the war effort to kill godless commonists. Therefore, he placed marijuana on "schedule 1" of his new "controlled substances act." Drugs listed on schedule 1 such as heroin are defined as having no medicinal or pharmacological use. There it stays.
