South Carolina is an "equitable distribution" state. The judge decides what is "equitable". There is no universal answer and I'd imagine an attorney would tell you that he can't guarantee an outcome. There are too many variables that change what would be "equitable" to say with any certainty. Length of the marriage. Kids. Relative incomes. Mental health issues. How much equity was in the house before the marriage. Luck of the draw with the judge. Assets the spouse had before the marriage that weren't co-mingled during the marriage usually stay with the spouse.

Document, document, an have documents. If you are divorcing, remember, financial survival first, emotional survival you can work on later. At least that's how a friend of mine handled it when she caught him cheating on him. She remained cool the entire time and when I asked about that, she said financial survival first.
