I'm doing my sisters taxes and not sure about one of her medical expenses.

She had a breast implant rupture that was possibly leaking silicone in 2016. She had surgery to remove both implants to the tune of about 7,000 to include doctor consultations and surgery. No new implants or other reconstructive surgery.

Her insurance did not cover anything related to this surgery.

Is this a legit medical deduction for tax purposes, not legit, or an aggressive deduction to debate with IRS in case of an audit?

The cost of removal of the ruptured implant I would think was medically necessary and therefore a legitimate deduction. Any incremental costs for the removal of the one that didn't rupture would be purely cosmetic and therefore not deductible.

I would deduct. Might be an argument over removing the one that did not leak but I would still deduct the total cost.

Internal Revenue Code Section 213(a)(1) tells us that you if you itemize, you can deduct as a medical expense amounts paid for the “diagnosis, cure, mitigation, treatment or prevention of disease or for the purpose of affecting any structure or function of the body.”

Assuming that the rupture made the surgery a medical necessity, yes it's deductible.

Yes that's what I am thinking. The other one actually fell apart in the surgeons hands as he took it out, so it was a health risk as well.
