Still have to file 2015 and 16. I won't owe for either years. I called one of the big tax companies, 1040a by the way.

They said because of the trump executive order they can do the not pay thing for 2016 but not 2015. Now what happens if I file 2015 myself? It's $325 I'd rather keep if I can ya know? Will they just take it out of my my return regardless?

Each tax year must follow the laws in place at that time. Trump's executive order cannot apply to previous tax years; only the 2016 tax year and forward.

Ok that settles that. Wish it would have been retroactive, if that would have even been possible/legal.

I think I am correct but it has been a couple of years since I have looked at Obamacare. I think the way the "tax" was set up the IRS would not come after you if you did not pay the tax. However if you are due a refund they should be taking the "tax" out of the refund. Having said that (they won't come after you) there is a good chance that you will get an automatic letter from them asking for the payment but NO follow up. End result would be you did not pay the tax.

Hopefully someone who has done the above will share their actual experience.

Hmmm. So if they owe me a refund, I file and just leave the obamacare fine blank, they would actually issue the full refund first and then send a "bill" instead of taking it directly?

No

The IRS will probably correct your omission of AHC and deduct the penality from your refund. The short story is if the Gov owes you money they will deduct the penality but if you owe then the money they do a poor job of collecting.
