Okay, I re-read the paperwork I personally received from the court clerk. It said I have "Thirty days from the date which I was served that motion to file a motion to vacate the motion to strike the answer, provided I answer the Interrogatories." They sent three. So.... I over the phone went and told them I would pay them. Not so fast.........

1. I think them claiming they got a judgement was deceptive. I think they think I'm stupid. So far, I have shown them I am.

2. They are an assignee. Yet they purchased this after it defaulted..

3. I think I'm going to make formal demand for them to not contact me except through Certified mail, call them out on how they told the Court they didn't know where I lived and yet mailed me there.. claimed they had a Judgement July 7th when that isn't something I find when I review COURT documents...

I think the Certified letters go out tomorrow, including me in writing undoing whatever was said on phone. Also, I'm sure they know that if they could tact me through phone it's $1100 per violation as per FDCPA....

Your thoughts?

Generally, the members of CD do not have ESPN (sic).

Creamer: I still say pay Citi directly, with a certified check, or money order via certified mail.

Even the person who " works in the industry" admitted it will cause headaches, as Citi WILL have to notify the collection agency that they received payment...let THEM all have the headaches.

If you pay Citi, and then notify the collection agency that Citi has been paid ( you need to provide proof so copy all checks or money order to them), they HAVE to stop action and STOP their claim.

As I said it happens from time to time with medical bills for me that weren't properly submitted to insurance and therefore not paid. Once it's beyond billing time to insurance, they either have to "eat it", OR I have to pay them. It's usually NOT a huge amount and I absolutely refuse to deal with collection agencies.

If you have the full amount, pay Citi directly, if NOT, you MAY have to deal with the collection agency.

As noted, you will HAVE to pay someone. It WON'T go away.

You started the other thread 11 days ago. Why on earth have you not called Citi already? It's no wonder you are behind and in trouble with this

So, are you aware of the best phone number at which to reach the appropriate Department of Citi? Frontline CSRs have no power to recall the debt from the CA which is what I would absolutely love to happen.

You are just making excuses and I'm not tracking down the information you should have been able to obtain easily in this timeframe.

Excuses? Watch it, you... Since my last post,. I've obtained 4 e-mail addresses including of the CEO and mailed - well, e-mailed - out my plea to recall. I'm also reading about how, as an assignee, Pressler and Pressler (garbage collectors) have been tasked to collect the full amount, and have been instructed to take nothing less. In my last Certified AND regular mailing to P&P, yesterday, I invoked my FDCPA as well as DV rights and included a Cease and Desist, answer to their Interrogatories, and another letter demanding (as they use same word, "Demand") FULL PROOF of their standing and right to collect.

I feel this will be getting yanked back to Citi very soon. Just gotta find the right receptive person or department there..

Anything else I should research? And assume I mail a letter tomorrow night, or Tuesday, after work . .. What generally should it say? (To Citi. Address issues... To their legal department? WHERE?)
