Income tax question about Injured Spouse form
I am working on my taxes. I think I will be filing married filing jointly (largest possible return that way).
I will be filing electronically and mailing in the injured spouse form as my husband owes back child support.
All the income for 2008 was mine.
My question. How does the IRS determine how much, if any I will get to keep? If 100% of the income reported is mine does that mean they will let me keep 100% of it?
Any help is much appreciated!

Yes. If 100% of the income is yours you will get all of it back to you. I know because I had to do this the last 2 years. I could not electronically file the injured spouse form but I electronically filed the taxes and sent in the injured spouse form. You will get a check and not direct deposit. If there is government stimulus checks this year you will get half and they will keep half for his bill. Hope this helps.

Hi, I am in the exact situation as you. All the income is mine and he owes the debt. what have you found out? how long does it take to get your check??

The check will be in your name only since it is your refund. It can take anywhere from 6-8 weeks from what I remember.

u can also go to irs.gov, find publication 17, and get hard evidence.

Are you all from California because I've been told that this state does not have an injured spouse provision? I am in the same boat!

There is a formula they use to calculate how much you will get back. I account for 100% of our income but did not get all the withheld taxes back in 2008. They also withheld 1/2 of the stimulus check.

Awhhhh im soo upset.... I was waiting for my refund ck to be direct deposited into my bank acct this wk and was just told it could take up to 11 wks before i get my refund that will be mailed to me and thats if nothing else goes wrong!! Like it getting lost in the mail!!...i filed joint, my husband owes about 1,500 for bk child support and he was injured for about 6 months.....
