Hello All,

Before anybody starts saying how bad it is to talk on the cellphone while driving and etc let me explain the situation.

My mother was flagged down by a bicycle cop and cited for using a cell phone in her right hand.

She uses an iphone and ALWAYS has the earphones that come with it attached to her phone. Its practically fused to the handset.

So she gets flagged down by the bicycle cop while she's talking on the phone with the earphones of course. She stops and presses the end call button as he's walking over to her side.

Anybody have any information/advice/experience with this issue. The fine itself is not that big of a deal, sure it sucks to lose $75 but I can't shake the feeling that she got victimized by a ticket happy power abusing bike cop trying to earn his squad car. My mom drove down the same street an hour later and saw the guy still ticketing other people. Just want to know if its worth fighting.

If she has the time and inclination it's worth showing up and pleading guilty. Usually get a reduced fine at the very least.

But the judges are pretty hard on those pleading Not Guilty - I'm pretty sure the law is NO cell phone use while driving in the city, period...

Thanks for the reply, just annoying because she was using earphones. And the law states seems to state its fine if its handsfree. Kinda messed up to write her a ticket when she is ending the phone call as a courtesy.

See if you can get in touch with the prosecutor for her date in traffic court. Many times you won’t know who that is until the day of or when you show up. Best advice is to go and talk about the circumstances involving the ticket 9 out of 10 times positive things happen. The worst that can happen is the charge as it presently is will stay the same.

The cop probably saw the phone in her hand, didn't see the earphones, and took the definition of "hands free" literally.

If she has the time, she should give it a shot.
