I received a photo radar ticket in AZ. I also had one last May and since my driving record is so clean I just paid it and accepted the points. However, if I do the same with this one, I will be 2 points shy of having a suspended license and I think that might make it so my employers insurance won't cover me. A big part of my job is driving, and I will either be demoted or terminated.

No big deal, I figured I would do traffic school online and forget all about this. Turns out you must do traffic school seven days before your court date... I was six days before my court date when I found this out. I checked my tickets fine print and confirmed this is true. Now I am panicking.

I could go into the court tomorrow and request an extension for my court date (which is only a few days away now). But, what if it is too late? The ticket and city website don't say anything about how long you have to request, but I know in CA you must request 10 days beforehand. If I go in and request this and they decline, I am totally screwed. I could very well lose my job. I could call before I go in and anonymously ask if their is a time limit to request an extension... but even if there is no limit, I have no guarantee they will grant me an extension. Also, I will have to give them my information when I make the request... which means I will be waiving my right to proper service and acknowledging the fact that I received the ticket.

BUT... I have not been served yet. Couldn't I just ignore this... let the server come... take the $25 fee for being served... and force a new court date? That way I would have time to do defensive driving. This seems like a better option than letting some clerk at the court decide my fate.

By the way, I'm aware this isn't the type of photo radar that will just go away if I ignore it (they eliminated almost all of those in AZ.) I have no choice but to take care of this. I just think I will be able to extend the court date and allow time for traffic school if I force the process server to be the one to serve me.

Call the court clerk and ask them for advice. Or call an attorney.
