neighbor's tree complaint (Phoenix: lease, mobile home, live in)

I live in a mobile home park, my next door neighbor has a tree, this tree's roots have raised the cement drainage ditch that seperates are properties. This drainage ditch is vital after it rains to prevent any flooding in the mobile home park. This tree has gotten so big that its roots have raised the ditch to where the water doesn't drain out any longer and the water now just sits in small pools. This can now be a potential hazard, especially as an attraction to mosiquitos (West Nille virus). The neighbor refuses to do anything about his tree. I am sure the cement drainage is part of the city and not anyone's private property. Is there a department or someone in the City of Phoenix that I can contact to complain about getting this corrected?

I would think that your first complaint should be to the park management. They have the responsibility of making sure all residents are in compliance with the park rules. I am sure that if your neighbor doesn't do something about the tree then management has the right to take action and remove the tree themselves.

The issue is who owns the property? If it is a private community mobile home park that is charging rent or lease each month to those who live there, then the issue needs to be directed to “that” owner of the park. They would be responsible for all water runoff on their land.

If the park is made up of individual ownership then each owner/resident is responsible for their own property and must control the water runoff.

If you feel you need someone from the city to intervene then you might want to check with your city councilman’s office for your district within Phoenix. They are always helpful and can direct the problem to the correct department within the city government. If your not sure which city council district you’re in check online with the phoenix.gov website, or simply call anyone of the listed districts to redirect you.

You might need to get city mediators involved to try and bring some understanding to your case.

I don't think you are quite at the point of needing a "mediator" from the city or anywhere else. The prior advice to contact the City Council office for the district you live in was good; they can either help you or direct you to the appropriate city office and work with that office to get the matter resolved.
