Slight problem with a prowler in my neighborhood, harmless so far, but creepy. The police can't catch him, and the residents are all paranoid that if they set up anything to trip him up, that they'll end up being sued by him. Is this realistic? Was there some major instance of this that caught everyone's attention? Three people in a row expressed this worry to me.

I'd be very worried about some kid getting caught in a booby trap.

No information on a particular major instance, Voebe . . .

Unfortunately, there's always some scumbag Ambulance Chaser out there ready and willing to pounce on something like this no matter how outrageous it may appear.

Personally, I think lawyers will be the ruin of this country. I'm not a fan.

Don't set up any booby traps, just arm yourself as allowed by the Second Amendment. And if anyone comes on your property without cause you are in your legal right to defend yourself. Remember the phrase, "I was in fear for my life".

Criminals prey on the weak. Do not be weak and you will be much less likely to be a victim.

Some of that paranoia might be coming from Prop 114 on the ballot this year. See the link for ASU's analysis on it and description of it. Keep in mind this is seen by some as superfluous because there is no known instance where a crime victim has never been sued by a felony perpetrator.

I'm not aware of anything regarding booby traps but I could see it being an issue if the wrong person is caught/hurt. So it seems unwise.

Be very careful passing out legal advice on self defense.

I would certainly *like to* agree with the premise of "criminals don't get to sue", the lawsuit justifying the law really gives me pause. The "criminal" in that case was an accused shoplifter who died, apparently due to the actions of a rent-a-cop. Last time i checked, shoplifting wasnt cause for the death penalty, and personally, i think *real* cops go way too far in their use-of-force quite often. In fact, this law would only apply to felonies, so it wouldn't even have prevented that lawsuit. Big money judgements can and *should* deter reckless & dangerous behavior. In the case of a "real" felony, I don't see any Arizona juries awarding a criminal any damages..

To answer the op's question, there was a criminal case against a business owner in Florida who, after several break-ins, set an electrified booby-trap which killed an intruder years ago.

Apparently the business owner did beat the charges..
