I am from out of state and was recently there in the Phoenix area for vacation for the first time ..Didn't know about the cameras of course and now that I am home, i get a notice in the mail for a speeding ticket in Tempe. So of course I went to the photonotice.com to view the video. Now that i am researching what my optiosn are now, i see that if you just ignore process servers, then the ticket goes away in 120 days. Can someone tell me if i am screwed since i have clicked on the link at photonotice? I dont see how that could be used in court as proof of service. It doesnt tell you that by clicking on it you are waiving to be served.

Anyone from out of state clicked on the link and then just waited to see what happened?
I definately dont want the court to say that i was served and then suspend my license once I wait past the due date on the ticket.

Thanks for any help.

Hey Wash, from New York here and had the same thing happened which I wrote on page 7 of this thread. On a wait and see mission as well. I also clicked on the site and also called the number well hubby did and spoke to woman on phone. My 120 days will be up on 8/14 so I guess we will see. Still not sure what I should do, as I don't know about taking the test in front of a notary and you can't find that out without paying for the course online!

I was issued a red-light photo citation on 3/26/09 (for unwittingly running a red light at a very low speed, putting absolutely no one in any danger) and my arraignment date is tomorrow (5/26/09). I never responded to the citation and I know that a process server has come at least twice, but at my apt. it's just me and my girlfriend and she is in cahoots with me in avoiding service. I'm anxiously waiting for tomorrow to check the court website to see what develops with my case. I'm half-tempted to show up to the hearing as an observer (without any identifying documentation, of course) just to see what happens...

I have been extensively researching my options to avoid the $300 fine and traffic school, so now to the point of my post: I'm pretty sure that just checking the photo notice website to view the video is NOT considered being served. I checked my video when I first got the citation, and if this were enough to consider being served, why are they now sending a process server after me? Also, just because someone logs into the website with a violation and a PIN, that doesn't mean it's the person whose name is on the citation. It could be a snooping household member that opened your mail, or someone who found the citation on the ground, in the trash, etc and was curious. I'm no lawyer, but it seems to me that the equation of simply logging in to the site with the notice no. and PIN with service of process would be fraught with legal difficulties that prosecutors would much rather avoid!

I'll post back tomorrow if there's any new information about my case. Wish me luck!

EDIT: When I was researching online traffic school, they said that I would just have to take the final test at a FedEx/Kinko's Store (I guess they have notaries at all of them).

The online school I used used the UPS stores. No notary involved. I think the "notary" thing comes up with someone who is out of state.

That's interesting...I guess now that I think of it the woman I spoke to never mentioned a notary, just that I had to take it at a FedEx Kinko's (or possibly a UPS Store--can't remember). So maybe is an out-of-state thing to have to use a notary, though it seems illogical to require a notary only beyond state lines.

OK bowlingblogger let us know how it goes being a spy, LOL. The cites the gave me to check, did say I had to use a notary, ugg............can't imagine though sitting in a fedex store taking a test! They don't even have chairs in them here in NY!

It was online, and took about 15-20 minutes max, at the UPS store. The Fedex stores do have chairs at their computers.

I got this information and paid the $58. I thought it was well worth it. They not only got my citation dismissed but I did run into some trouble and they helped me out with no problem. I was very satisfied with this company. They were very nice and very helpful. They are doing a great thing for us and anyone that is against photo radar in this state should value and appreciate what this company is doing for us. I suggest paying the $58 dollars. It's alot better that paying that fine and taking any chances on theories and rumors. They do guarantee that it will work. What do you have to lose? Help them help others!

If anyone's been wondering, I haven't posted again because nothing has changed--my citation is still reflected on the state court info site, but nothing new has been posted--no new court date, nothing. I expect one of two things to happen: either the 120 days will pass (July 24th is the last day) and it will be dismissed; or, around day 118 they will try to serve me again once or twice and when they can't, it will be dismissed. Either way, I will post the results. Wish me luck!
