Default Proposition 202 Weakens the Laws Sanctioning Those Who Employ Illegal Aliiens

This Proposition will probably pass despite the fact that approximately 3/4 of Arizonans support tighter controls on hiring illegal aliens because it has been heavily advertised as strengthening such regulations. It does not. It was sponsored by a coalition including fast food franchise owners who want to replace the stricter standards already in place under Arizona law. It really is a shame.

"Tim Rafferty and Richard Martin of RidersUSA argue against 202 saying,

"If previous ballot measures are indicators, the majority of Arizonans believe that the state needs to "Stop Illegal Hiring." If truth in packaging were applicable here, this legislation would be called "Employer Amnesty." This legislation removes two key provisions of the existing Employer Sanction's Law strong provisions which had the agreement of the legislature and Governor. The first essential element that is removed is the mandate that all businesses use the highly effective, user-friendly federal E-Verify system. E-Verify assures that only legal workers can gain employment in Arizona and has a provision for correcting errors. "Stop Illegal Hiring" offers the less-stringent federal guidelines presently in force as a substitute for E-Verify and relies on documents that have been easily forged and have been found counterfeited on Phoenix streets. Hiring illegal workers takes jobs away from legal workers, lowers the prevailing wages, and flies in the face of law and order. Vote NO on PROP 202."

Default Arizona's 'Stop Illegal Hiring' Act is a Sham

"The opponents of immigration enforcement have stooped to a new low in Arizona with their latest attempt to undermine the state’s workplace verification laws. After exhausting their usual tactics, they are resorting to outright and intentional deception of the voters. This November, Arizonans will vote on Proposition 202. . ."

". . . Arizona does not need a new law against illegal hiring. It already has the toughest workplace enforcement law in the country. The Legal Arizona Workers Act (“LAWA”), which was enforced in the beginning 2008, is the first state law to require all employers to use the E-Verify worker identification system. E-Verify is a nearly fool proof electronic data-base system that makes sure an job applicant is here legally. Arizonans on both sides of the immigration issue agree that the law has had a huge impact in keeping employers from hiring illegal aliens and, in turn, causing the illegals to leave the state."

"The Stop Illegal Hiring Act effectively overturns Arizona’ current employer sanction laws. It completely removes the E-Verify requirement that was central to the success of LAWA. It forbids Arizona from acting against employers until the federal government does so first, but it’s the federal government’s failure to act that makes the law necessary in the first place. On top of all this, it gives amnesty to employers of illegal aliens, and bans whistleblowers from alerting the authorities to illegal hiring."
