Ya when I asked my bro about it, he actually said he had received mail from the mtg company at his house about the default, (addressed to the landlord) so thats how he found out so early.

It wasn't the actual auction notice that he saw first.

I'm not nor have I ever lived "RENT FREE", I have been paying my rent to the management company who has been giving it to the owner of the property.

I think the rent free issue came up with respect to security deposits, which in some areas are tied to the amount of rent (first and last month's rent payable up front). Here, they are more based on cleaning, etc.

There's some good advice here about how to proceed, you aren't automatically out of the house just because of the foreclosure.

The house would have been in the forclosure state for a while before going to auction, so the landlord had to have known about it.

Non-Refundable deposits are just that, non-refundable, not sure where the confusion is with that.

Right, and if the buyer lets you stay for the term of the lease, if there is one, or gives you proper notice under the law if there's not, the lease (or the landlord-tenant law) isn't broken, and there's no other recourse against them.

Yep - hence why I posted it - because your additional post then said that Arizona laws favored the landlord. And the issue here has nothing to do with any favoritism (which you are basically incorrect on btw)

Well, I don't know much about the law in AZ as far as rental agreements, but I think the OP should see a lawyer and discuss this. I think it sucks that he has such a short time to deal with this. Legal aid probably handles this. OP, it sounds like your about to take it up the ying yang.
