I heard a rumor that someone was issued a ticket for using a cell phone in the city of Phoenix (while driving). It may have been related to texting or just making a cell (I don't know the details).

Is all cell phone use banned or am I able to make a voice call? I know texting is banned (that's just stupid to text while driving anyways). Yeah, using the cell isn't great either but it's not as bad.

Was just wondering if there's a current/new law. It would be bizarre to have differing cell phone use laws by city (does that even exist?). I think it would be more a state law.

Thanks in advance.

There is no "hands free" law in place. You are correct about the texting ban.

I’ve never heard of any law in Phoenix dealing with cell phone use, however I did hear that Tempe has a law regarding cell phones while driving. With or without a law it just doesn’t make any sense to use a cell phone while driving: voice ~ text ~ speakerphone ~ voicemail or playing games on it. Driving is difficult in traffic and it isn’t improving with more and more cars on the streets. Everyone needs to pull over into a parking lot or a side street and talk on their phones ~ not while the car is moving! It is legal to use your cell phone to report your accident location to the police and call for rescue vehicles however.

It is a violation of Phoenix City Ordinance (law) to text while driving; still legal to talk and drive though.

News to me, and I live here, so I checked. Could not find any such ordinance.

I can’t find a thing about cell phone or text messaging while driving in Phoenix.

As for Tempe, a friend said that they were stopped by the Phoenix PD near Tempe, and the officer told the driver that while in Phoenix he could not write a ticket, however the next traffic light they would be driving in Tempe and they would issue tickets. I don’t know anymore other than that. I also failed to find anything in Tempe city code about the use.

CHARTER

There appears to be no laws on this topic, however the bottom line is "don't do it" for safety reasons.
