Misdemeanor DUI charge????? He killed someone. There is nothing misdemeanor there. Unless I am wrong, from what I have read, he was never arrested.

That people are stroking their chins and speculating about the DUI aspect and how their friend didn't go to jail for their DUI while ignoring the fact that someone is dead pretty much sums up this forum. Since I was the one here who most recently used the chin stroking emoticon, I'll assume that was aimed at me.

In case it went over your head, the nature of my speculation was whether the offense described by the media as "disregarding a traffic control device" might not have actually been something more egregious; something that if punished more severely might've taught the driver more of a lesson and prevented this.

I might have read your post, but it didn't register with me at all and I forgot there was an actual chin-stroking emoticon. I'm not passive-aggressive in the least, so if I was going to aim a response at you, I would have quoted your post.

The law is a particular thing. He hadn't killed someone "yet" because the woman hadn't died yet. He was arrested and probably released on his own recognizance. He will be sent a summons to appear by mail. The charge may be upgraded pending toxicology results.

So we come back to my original response, namely that "no one has mentioned that he is a spoiled rich kid with an attorney for a father and a doctor for a mother" because so far the point and particularly the class-envy sentiment behind it is heretofore irrelevant.

To summarize a complex area of law, people aren't supposed to be kept in jail pre-conviction even for very serious crimes unless they are a flight risk (or a few other limited circumstances not applicable here). So the fact he isn't in jail doesn't really say anything in particular about the seriousness of the crimes he may eventually be charged with.

Funny how that whole "innocent until proven guilty" thing can come back a couple hundred odd years later and bite you in the butt when all you reallly want to do is string somebody up...

But that wouldn't make Creeps feel better about the internet and this forum in particular....

As for the "disregarding a traffic control device," that could have been something as simple as a cop giving someone a break on a speeding ticket to avoid points. That is a pretty open ended violation that gives a cop wiggle room to be a semi-nice guy that day.
