Question Car Accident Question

Well, as I type this my nerves are still frayed after my vehicle was hit for the THIRD time since 09/29. A shirtless man who appeared to be under the influence of something was flying down Brereton Street in Polish Hill, lost control, totaled one parked car (not mine, thank God), and pushed her vehicle into my vehicle, which was parked behind hers. He claimed someone was trying to kill him. I have damage to the front of my vehicle that will have to be repaired. Anyhow, before collapsing and being taken away on a stretcher the driver of the first vehicle claimed he didn't have a license or insurance. According to my insurance agent this means that in order to get my car repaired I'm 100% liable for a $500 deductible that I can't currently afford. I drive for a living, so I can't be without a vehicle, so as you can see I'm in a very tight bind right now. I was just wondering if anyone knew of any way I could get around having to pay ANOTHER $500 for ANOTHER car accident that wasn't my fault. Has anyone been in this situation before where their car was parked along the street and hit by other vehicles?

The police basically ignored me and seemed irked when I asked them for a copy of the police report number, which I resented, but I'm going to watch KDKA later to see the story, as they were there filming and interviewing people.

For the record I also would highly advise against using Grace Robinson/State Farm as your insurance agent. I've been treated like a burden upon them throughout all of these ordeals when I've done nothing wrong. I plan to switch insurance carriers as soon as I am able, and I'd greatly appreciate recommendations for great insurance agents in Greater Pittsburgh as well!

Yup, if the other person doesn't have insurance you're SOL as far as the insurance company is concerned (meaning you must pay the deductible). You'd have to take them to court over the money, and if they don't have any money to begin with you are wasting your time.

As far as the police are concerned, that sounds like the norm. Sorry man and good luck.

All I can say is that after being hit three times since 09/29 in accidents that weren't my fault and being out so much money in the process (not to mention the neck pain) I'm about ready to give up on Pittsburgh and move to the suburbs where people might actually know how to drive!

There's REALLY no way around being out-of-pocket $500? I hate to say it, but I seem to always have legal counsel on standby anymore. For as much as people malign attorneys I'm glad Pittsburgh has so many of them.

Hmm, I'm no legal expert (where is Brian!!?) but basically the way it works is this:

- Let's say that have Erie Insurance and you have State Farm. They get into an accident with you and it's their fault. Erie will pay you for the damage and your insurance isn't really involved.

- Let's say that don't have any insurance and you have State Farm. They get into an accident with you and it's their fault. You have to through State Farm to fix the damages and thus have to pay your deductible since they have no insurance to bill. You have to take them to court to squeeze cash out of them instead.

Basically that's what deductibles are for unfortunately.

Also I reccommend Nationwide, they claim to be on your side in their commercials, I use them and so far so I'm pleased.

Unfortunately yes, you're out of luck....it's really no different then if someone vandalized your car. Unless the shirtless wonder miraculously has some money then there's not much you can do here.

I'll second a Nationwide recommendation...have dealt with 2 claims through them with no problems plus their rate was low as well.

I'd just like to add how much on-street parking blows. When I used to lived on a major roadway and my car was a damn magnet for vandals. Had my side view mirror popped off for no reason (I glued it back on), car was broken into once (pried the door), and another time they shattered the window (never took anything both times). One of my neighbors a couple doors up had her car wrecked in a hit and run. People are such pricks.

I can't ethically give legal advice in this sort of context, so this isn't legal advice.

But as another poster pointed out, this is what deductibles are all about. You can opt for lower deductibles, but then of course they will charge you higher premiums.
