Default Has Anyone Worked W/ a Realtor then Built New Home Instead?

WE are getting frustrated with the crap that is in the Upper St. Claire/Bethel Park area for around $225K either, the yards are way too small or worse yet not flat, there are no updates on the house, or the taxes put us out of our payment comfort level.
With that being said, we are working with a realtor, however we are considering building instead as we have found some somewhat level lots. The builders are telling us that that because the houses are not on the MLS that they refuse to work with the realtor.
Has anybody done this? and what if anything is the Realtor owed by us?
She did give us the name of the builder, but
#1. We would have found that anyway, based on all the signs they put up
#2 WE found these two new developements which aren't even advertized yet on our own.
