You would have to contact your local labor board and ask them, I doubt anyone here would know the legality of an employer doing that. If it is legal I guess the best solution is to NOT be late for work.

You may be able to call an attorney that specializes in labor laws and ask them as well.

CSD610 is right, ask an attorney for the actual legal explanation.

But, if you're supposed to work 40 hours a week for example and you only work 38...I know at my employer for hourly employees, they can either make up that time or just take it as a deduction in pay. We have employees that are salaried (37.5 hours) but can still earn overttime at an hourly rate. So, if the 37.5 wasn't met, yes, a deduction could be done if the time wasn't made up in the pay period. Employees who are salaried and are unable to earn overttime (higher paying positions) probably would not see a deduction.

For your individual situation and employer, you're best to consult HR and/or an attorney.

Hourly employees must be paid for actual time worked and an employer may not reduce or dock wages beyond deducting for time not worked. So, no, your employer may not dock you a straight $20 for being late 3 minutes. You may, however, be terminated for cause likely without recourse. You may want to consult a labor attorney and file a compliant with the state labor board if its worth it to you.

Legal or not, why not just be there on time and not worry about it?

My boss has a 7 minute grace period. But Iam always early so it dosnt matter to me. I am salaried, but if I work over 20, I do get overtime.

You know the hours you are supposed to be there and why not just be there a few mins early?

As long as he's paying you at least the minimum wage for the hours you are there and working, I don't see why not.

I'm suprised you still have a job if you're late that frequently to complain about this.

It's illegal to dock pay more than the time is worth. It's also illegal for employers to dock pay for broken merchandise or company property.
