According the bolded statements, the Geneva Conventions didn't protect these men because they were not soldiers, so it must be that we were not at war with anyone. Which is why many Americans didn't want Bush and Cheney to get by with prosecuting a war - particularly one with the wrong country.
The Geneva Conventions aren't the only rules at play here. The United States is also party to several UN Resolutions regarding the definitions to be used regarding prisoners of war, and the treatment of such prisoners.
1) Barack Obama (and anyone with the last name Obama)
2) Anyone with the last name Clinton (especially Bill and Hitlery)
3) Harry Reid
4) Nancy Pelosi
5) Rahm Dead Fish
6) Adolf "Mike" Bloomberg
7) David Paterson
8) Sean Penn
9) any Democrat on the Suffolk County Legislature
10) any Democrat in the New York State Senate and the New York State Assembly
11) Any and all members of the Communist Party, Socialist Party, and all those fringe 3rd parties of Commies, Mao/Stalin/Che lovers, etc
12) Unions - especially labor unions, teacher's unions, and police unions.

Ah, but yes, their leader, bin Laden had declared war on the US in 1996 so they thought they were at war with us. Maybe our President, at the time, failed to see what had been done since he considered all their attacks to be something to be taken care of by police.
