The Geneva Conventions aren't the only rules at play here. The United States is also party to several UN Resolutions regarding the definitions to be used regarding prisoners of war, and the treatment of such prisoners.

Ah, but yes, their leader, bin Laden had declared war on the US in 1996 so they thought they were at war with us. Maybe our President, at the time, failed to see what had been done since he considered all their attacks to be something to be taken care of by police.
