Hypothetically speaking, does the term "community center" preclude it from Constitutional protection and places it into a general business/charity category?
It doesn't matter - the focus would be on whether the government's decision to disallow it (if that happened) was based on it being associated with a particular religion.
I understand this building has passed all zoning laws. The argument made by those who approve it was that it was a religious institution and was protected by the Constitution. But many others in favor of it have tried to minimize the word Mosque and are calling it a community center.
