This law banning the use/consideration of Muslim Law or any International Law in the Oklahoma Courts was recently passed with 70% of Oklahoma voter approval. Now the Muslim Group, CARE is suing to have it repealed.
Seems to me that in America, our courts should continue to base decisions on the laws of our country, not religion or other country's law. Britain, apparently is already using the Sharia Law in 85 Courts. When does a country stop being its own country?
"[In] Oklahoma, voters overwhelmingly approved state question 755 [to ban Islamic Sharia law], one of the most important initiatives in their state's history. This is great news. Just because something doesn’t exist doesn’t mean you shouldn’t ban it. That's why I have long fought for ballot measures to ban cat pilots, baby curling, and man-futon marriage."
How can ONLY using the laws of this country and not considering the laws that apply to another country (ie as in Sharia Islamic law) be unconstitutional?
Depending on the scale of it, that law is quite unconstitutional. Of course criminal courts wouldn't consider Shariah law(In which case the only valid argument for the proposal is a strawman as no one has seriously suggested that) but I don't see how this could constitutionally apply to civil cases. If two parties decide to make a contract that adheres to the rules of Shariah and doesn't conflict with Oklahoma law, who's to say they can't?
But I do have to lol @ banning something that doesn't even have a remote possibility of coming to fruition. It's right up there with banning human cloning, a science which doesn't even exist yet.

This is silly. It's really nothing more than a tempest in a teapot, and is indicative of the outright disdain that our politicians have for the voting public. Sharia only applies to Muslims. IT DOES NOT APPLY TO NON-MUSLIMS. And what's more, Muslims have the right to opt out of it if they wish. It's judgements are nonbinding. The people of Oklahoma have no idea what they just voted against. I doubt that very few people even know what Sharia is.

Exactly. They don't. They think it means that muslims want to go around chopping the hands off of theives and stone the adulterers to death. When in fact shariah applies to all aspects of outward islamic practices. Praying five times a day is following Shariah. Wearing a head scarf is following shariah. Not commiting adultry and not having sex before marriage is following shariah. Not eating pork or drinking alcohol is following Shariah. And yes, you are exactly right, Shariah only applies to muslims. It is the outwards laws that guide muslims in their daily lives from the individual realm to the social realm to the political realm, but it is stated in the Quran that as long as a law does not conflict with Islam, a muslim should abide by the laws of that country. For example, the practice of marrying up to 4 wives which is allowable according to Shariah but is illegal in the U.S. Because it is illegal here, according to Islam, a muslim should follow U.S. law, not Shariah in this case.
If that's the case, then let muslums have their own court to try their own cases based, on the 'law' of their own religion. Why muddy our court system which is already overburdened with countless laws?
If you want Sharia Law, there are lots of place on this planet that offer it...... don't let the door knob hit cha.........
Ironically.... the fact that we don't have it, is the very reason you are able to leave here "freely" and back to where you came from. Go get allllll the Sharia you want. Quit b@#tchin' about it not being here!
Excuse my french...
