--A man who claims he failed the Massachusetts bar exam because he refused to answer a question about gay marriage has filed a federal lawsuit, saying the test violated his rights and that his religious beliefs were targeted
I haven't seen the test but I'd imagine the subject was the Law of the Commonwealth of Massachusetts, not one's personal beliefs. I'm sure the question began with something like "According to the Law of the Commonwealth of Massachusetts..." and not "How do you feel..." If the guy doesn't know the Law, and hence, can't answer questions about it, he should not have passed the exam. Sure, the guy has the right to protest the legality of gay marriage, but in doing so as he did, he sacrificed the bar. That was his decision to make and now he has to deal with the consequences.
Oh and I'm sure THIS question is the one that killed him, not the others he answered incorrectly.
exactly, a lawyer with morals? what will they think of next?
but seriously, I totally agree with lammius. the guy probably failed miserably and is digging deep for an excuse. and besides, I thought lawyers were supposed to be able to separate themselves from the actual case? like if you thought your client was guilty, you're still supposed to defend them?
The guy failed. He voluntarily refused to answer a question and it cost him. If they give him his license he should have to tell everyone he represents he really didn't pass his bar test.
