If you make it compulsory for everyone to have insurance then it needs to be done through the taxation system ... i.e. universal taxpayer funded healthcare.
I don't see why insurance companies should get a free ride on the back of the law.
You don't see why? Really? That's how Obama was able to get it passed.
The only real question is whether our newest Justice will have to recuse herself when the battle reaches the Supremes.
Yep, she's in pretty deep
Kagan was representing Obama in all the petitions to prove his citizenship. Now she may help rule on them.
This is really ugly. Chicago Politics; and the beat goes on and on and on...
Once again the US Senate sold us out! Well, someone figured out why Obama nominated Elana Kagan for the Supreme Court.... Pull up the Supreme Courts website, go to the docket and search for Obama. She was the Solicitor General for all the suits against him filed with the Supreme Court to show proof of natural born citizenship. He owed her big time. All of the requests were denied of course. They were never heard. It just keeps getting deeper and deeper, doesn't it? The American people mean nothing any longer. It's all about payback time for those who compromised themselves to elect someone that really has no true right to even be there.
Here are some websites of the Supreme Court Docket:
You can look up some of these hearings and guess what?? Elana Kagan is the attorney representing Obama!!!
Obama is systematically trying to hurt America. Obama, the argument goes, is not an incompetent boob in over his head. Nor is he is not some well-meaning community organizer who has seen his plans go astray.
Obama is a dishonest, manipulative liar who actually is pursuing an agenda that he hopes will take America off the international leadership stage. He wants America to fail so that the vision of Internationalist socialists can be realized. America is hated by the elite intellectuals of the world because we have been the single biggest roadblock to their plans to establish a one world governing system with them in charge.
His Character and his Policies have dictated his fate
Judicial activism is when you disagree with them and "merely upholding the constitution" is when you agree with them.
Glad we could clear that one up.
Good, you understand that upholdingwhat's in the Constitution is not judicial activism, and that changing what the Constitution allows is judicial activism. You're getting there...
Doesn't really matter..this is going to the Supreme Court and in my opinion will be ultimately struck down as unconstitutional which will be the ultimate irony considering Obama was a law professor who taught this stuff...it is by far overreaching as far as I am concerned, with nothing else that even comes close to compare it to in history...but then we need to start over again and come up with something that really works and doesn't destroy the quality of our care and the economy...

I believe she will have to recuse herself, as she has done with other cases when she was SG.

This has the potential to be delicious in 2012, an election year, when obamacare could be struck down by SCOTUS as unconstitutional.
And what makes you think the tobacco inititiative is not doing that?
That is exactly what it is doing - providing money to States for health care to children It is a program already in place, and has been since the 1990's.
It has nothing to do with the federal government forcing everyone to buy mandatory health insurance from Private Companies.
Funny how some people are opposed to judicial activism when it suits them (e.g. Iowa) but are also in favor when it suits them
Anyway, let it go to the Supreme Court. As the cost of health care rises, as States cut back on their health care programs, as Medicare & Medicaid eat up more and more tax dollars and as employers continue to cut back on benefits, even Republicans are going realize that proper health care reform is inevitable.
That would be Medicare for all Not the Government forcing folks to buy health insurance from PRIVATE COMPANIES.
